I have joint custody of my son and he lives with me 100% of the time. I am the Custodial Parent and have been for over two years now. The NCP has no parental rights since she was in contempt of court on several issues. The NCP has called to check on her son only 1 time since I received custody and that was 4 days after I got him. I have not heard anything from the NCP in over two years now but I did get a little child support last year. I have not got any support this year. My son does not know his mother and I do not believe I could ever share him with her. Was wondering if I should file abandonment charges or should I just let it go. Please give me some advice. Would it be beneficial to my son or myself?

You can take her back to court to enforce making her pay up.

Do you want the money the court ordered? In GA, you can file abandonment charges if there has been no support for 6 months. This could bring criminal charges against the NCP to enforce paying support.

It is hard to say what you should do, but I would talk to your attorney as to your options

How old is the child, are you re married, does he call her mom, and do you really need the money. Think about all these things first. Is that money worth the disruption in his life, just think about it . Let me know

My son is 4 and he does not know his mother. I am not married but I could use the money. How would filing abandonment charges disrupt our life? Would it force her to be involved in my sons life? If this is so then I would never do this.

The Office of Child Support Services is trying to help me get the ordered child support. She paid a few months last year but I think she may have been on probation and her probation officer made her pay. Anyway if the OCSS can't get any money I wonder how abandonment charges can. She has already lost her drivers license and her income tax refund would be held if she ever files taxes and receives a refund.

Abandoment is used in various ways in GA and TN, one is to put them in jail for a period to remind them to make child support payments

That's why I asked the question. Since abandonment is a criminal charge in GA, it could mean jail time if she doesn't pay. But you have to decide is you want to take that step. The only reason for you to file abandonment charges is if you are willing to have her jailed in order to collect the support.
