My fiancé was arrested just about one month ago.he was charged with armed robbery and first degree burglary.. he was with two other guys they walked in the back door it was unlocked a dog started barking and a 65 year old woman came downstairs and saw the three of them she screamed and one of the guys grabbed her by the wrist and told her to shutup that they weren't going to hurt her he was the only only one that touched her.. he had a knife in his hand and the second guy had a tire iron.. they took money and left... my fiancé did not have a weapon or touch the woman period.. is it likely for the armed robbery charge to be dropped ? I'm so scared I don't know what to expect.. I was hoping he could get probation and house arrest instead of time in jail.. is that too much to expect?

Sorry, but he was involved, they were violent, had weapons. They are lucky they were only charged with first degree burglary. There must have been other charges, what were they ?

If this had happened in Toronto, they would be facing jail time and numerous charges, especially after a senior citizen was threatened.

I don't think you should expect charges to be dropped. He was there and involved.

Greetings inlovewitmybaby. Do you mean that your fiancé has two (2) felony convictions already? Or do you mean that he is facing felony charges?

Of course they will not be droped, in fact he should consider making a deal to testify against the other two.

Just being with them, makes him part of their weapons. In fact I would foresee them adding some additional charges, kidnapping, if the one person grapped this women and woul not let her go if even for a few moments that is still kidnapping

So they need a seriously good attoreny, but expect him to be gong to prison for a while

Yes, it's wayyyy too much to expect. This is a serious offense. He'll probably be away for a few years. The better his attorney, the better his sentence.

He is facing two felony charges he's never been in trouble before this

The guy that grabbed her got a charge of assault and battery of a high and aggravated nature, armed robbery, and first degree burglaryand my fiancé and the other guy got armed robbery and first degree burglary.. we live in s.c.

Way back in 1963, three friends and I robbed the Western Union office in Charleston. We had guns. Nobody was hurt. Nobody was touched. We were all young and first offenders.

I got 7 years. I spent one on the Charleston County Prison Farm, and two more in Columbia behind the walls.

I don't think things have changed much since then.

Thank you so much for your advice .its not what I wanted to hear of course but its what I needed to hear.what to realisticly be expecting.I'm definitely going to look into an attorney.. what would you think a likely sentence for him would be if he were to just have the same charges with none additional added?we're in s.c. he's 19

Thanks for your advice.wow I was really underestimating the outcome then huh? Well its good to know what to really expect .so you had to serve 3 of the 7? Yeah things probably haven't chnged they are probably actually cracking down more on people because of how much cime there is now.. yeah he just turned 19 they did it in September of last year and they were just arrested in the past month.. im trying to find an attorney that will let me make payments because I don't have the kind of money they want upfront

I had another question too I looked him up on the public court index recently and it says case subtype: 180 day track do you know what that means?

I think before anything else happens you have to stop making excuses for him - if that woman had been injured or killed he would looking at a life sentence in many States.

He's also lucky she didn't shoot him - which is what I would have done, by the way.
