Theft under 5000.

Scenario. Me and friend are behind some auto shop trying to take wheels off a 04 Jetta GLI
Somebody sees, calls cops.

Look up-----police. So I run and get away from the mass police that show up, dogs etc.

My friend however, gets pinched.

He says EVERYTHING! My name my number everything not to mention we were there to get the wheels yada yada blah blah blah.

Cop calls me on my phone from a blocked number telling me to come back because my buddy snitched me out.
So I go back to the scene, I'm cuffed and told that "wheres the third guy?" and kicked around a little. No matter what I tell this guy, he doesn't believe me. I tell him fine beieve what you want. There was just tow of us. (later agress with me because there was only two)

I make a statement saying the wheels were worth 4-600 dollars (figured friend would say the same , which he did) I was there to provide a jack and lug wrench and to show him how to remove the wheel cap, hub cap. He was trying to take the wheels while I watched. To my knoledge, friend said the same.

I was super super super super nice to the cop and answered his questions in a semi vauge fashion. I didn't cause him grief and I asked if it shows that I wasn't resisting or being disresepctufl or unpolite and he said that forsure its in the notes and that I was easy to deal with and made his job easy. He thanked me for not being a prick and I said the same to him.

He advised me to look into diversion and maybe do some service beofre court to make it look good. I have never been in trouble with the law.

I am unemployed. WHAT DO I DO!?

Oh, when the police arrived, the wheels were still on the car, the hub caps were on the ground. Jack was in the back of friends truck.

You evaded the police. You can at least be charged with that.. why don't you know what you are being charged with. Get a lawyer!

Well guess I have to be harsh. Dude you were trying to steal. How honest is that?? Now your on here looking for advice to make it easier for you. Whatever, I hope you wear stripes well and I don't care who disagrees with me.

JUst what I should ask about or what you think the consequences will be. I have dual citizenship and I don't weant to that up. Im supposwed to see my father who I haven't seen in 1`0 years this summer, I can't not have that opportunity

First you should tell your friend he's an idiot because he snitched, and wasn't quick enough to run. Then you should beat yourself in the head because you went back when they called you. Next you should try to see if a lawyer will give you a free consultation and get a job or at least come up with some cash legally to pay for him cause without legal rep your probably going to get screwed...

If this is his first offense, and the cops said diversion, why can't he attempt to get a diversion program.

First, I had mag wheels. They were stolen when my car was at the dealership for inspection. I have no sympathy for you but that does not matter. Just making my thoughts known.

The legal side of this is something that I wrote. All of the provinces have something similar "“Ontario diversion program guidelines vary from region to region, courthouse to Courthouse. Eligibility for such a program is ALWAYS determined by the Crown Attorney's office. There are no exceptions. You are not required to have legal counsel in order to apply.

If the offense - theft - is not major (property was recovered, not a large amount, not a repeat offender) the Crown Attorney MAY approve eligibility into the diversion program prior to the Curt appearance. If there are prior dealings with the Police - and charges do not have to be placed, any prior dealings of a negative nature - the person will most likely not be eligible for the diversion program.

As part of the diversion program the eligible person will have to agree to complete certain tasks or obligations - perhaps watch a video, make a donation or volunteer time to a not-for-profit, write a paper on the crime.

When the tasks/obligations have been competed to the satisfaction of the Crown's Attorney he/she will recommend to the Judge that the criminal charge (usually, theft) be withdrawn.

Each courthouse in Ontario has a different diversion program and eligibility requirements differ from region to region. Eligibility for the diversion program is always determined by the Crown Attorney's office. If they deem a theft offence to be of a minor nature (usually a small quantity of merchandise was taken and the property was recovered), the Crown may pre-approve eligibility into the diversion program. A person will not generally be eligible for diversion if they have had prior dealings with the police (even if it did not result in a criminal charge being laid). Once in the diversion program, the eligible candidate may be asked to complete one of a number of different tasks. In some jurisdictions, a person charged with theft may be required to watch a video on shoplifting. In other jurisdictions they may be required to make a donation to charity or complete a minimum number of community service hours - or both. Regardless of the requirements, the result is usually the same. Once the diversion program has been completed to the satisfaction of the Crown Attorney, the Crown will recommend to the court that the criminal charge of theft be withdrawn against the accused person. This will result in the accused person maintaining a clean record (assuming they didn't have a prior criminal record).

If a person is not pre-screened as eligible for the diversion program, a lawyer may be able to convince a Crown Attorney to reconsider their decision.”

Going back was probably better than having the Police come to his house and arrest him there or put out a warrant for his arrest.
