I live in Florida, as does my soon to be ex husband. My mother died in October 2009. There is a lawsuit settlement coming in the next 2-3 months from FenPhen. My question is, if our divorce is not finalized before then, will he get half? We have been separated 2 1/2 years. There is a trust set up in my name, as well as my sisters and step father. What can be done to insure he does not receive any of this?

Assets acquired after legal separation from your spouse should not be assignable in a divorce proceeding, but I would have your lawyer address them proactively anyway.

And I assume you mean your mother passed in Oct 08, not 09...
