He can not file as joint without telling you, given the fact that you must sign the return - therfore he can't file as joint without your consent. Did he forge your signature on the return? Also, have you filed your own tax return? What filing status did you use? If you filed on your own the IRS will catch the problem and investigate. No need for you to sue your husband.
I notice this is posted in corporate law - are you asking about a corporate tax return?
So no problem - no harm, no foul. Your husband filed as Married Filing Jointly, which means he saved some money compared to if he filed as Married Filing Separate. There's still the issue of his filing MFJ without your consent, but honestly - what do you care? It seems to me that you have not been harmed here at all.

If he isn't paying child support take him back into the Court that issued the support order and force him to pay.
Causing problems for him in other areas of his life is not going to get child support for you.
