I'm turning 17 in about 20 days. My mom and dad are currently split up. My mom came home one day just around last September and packed up while my dad was gone and left with me and my sister. She moved into an apartment and moved her boyfriend in just a day later. She and my dad are still not divorced. My dad has no money, no job, no food, and is losing the house he has to move out soon. My mom is always drunk. She would make me watch my sister and come home at 3 or 4 in the morning trashed making a bunch of noise and I would be up so late dealing with the drunk fights with her and her boyfriend my grades started to go down. I race motocross and my mom said she would home school me and let me race and travel. She has yet to sign me up for the online classes or even make an attempt. I gave her the number and everything but she doesn't even have they money for them or the money for me to race. I paid for my first car when I was working at walmart over the summer and my dad took it. So I came up with the money to buy and old beat up cargo van that I am now working on and fixing up myself. My mom hates my girlfriend and would bribe me and say if you break up with her I will buy you this and that but I love her and my mom doesn't like her for the simple fact that she has taken her little boy away. Since I chose to stay with my girlfriend she said she won't help me out with insurance or anything. She has came home screaming at the top of her lungs crying because her boyfriend got in a fight with her and got peppersprayed at a club one night and had the ambulance and everything up there. My mom just got evicted from her apartment because of all the loud fights and everything. I clean and clean that apartment and my mom just gets drunk and messes it up. A mom is supposed to clean and cook for her kids... there is NEVER food at that apartment. She picked up and moved me and my 12 year old little sister to Florida one day taking us away from our dad and my sister out of school with a matter of three hours. We had barely any money and no place to go. We stayed there for six days and ran out of money so we moved back and had no furniture or anything. My mom lost her job at the casino because of it so we have no money now and we have like 18 days to get out of that apartment. I have a job working for this man named roger who pays like ten bucks an hour and he has a loft apartment in his barn that I can stay in and not have to pay rent just work for him. Am I eligible to get emancipated?

It is certainly a possibility, but you would need to speak with an attorney to determine whether this is an option. I suspect that the behavior your mom is displaying would get you and your sibling out of her home, but since your father is not doing so well, you may be placed into a foster care system if there is no other family to take you in.

Perhaps you could speak with your dad and see if he would be interested in getting help in getting a place for you all to live together, if you feel like it is a good possibility. There are social programs that can help with food and shelter costs, and if your dad is disabled (you didn't specify) he can qualify for further assistance. He can also seek out reduced legal aid services to obtain a divorce from your mother.

An emancipation could help you temporarily, but if you and your sister could find some stability with a trusted family member instead, I would explore that option first. Good luck to you.

But my dad is worried about nothing but my mom
He missed work because of my mom that's why he is out of money
He doesn't care about anyone but her...
My sister is fine... my mom takes care of her... when she is drinking she usually has my sister go with my dad or something my sister is in school and doing fine she doesn't ever complain I think she likes all the craziness for some reason but as for me I'm ready to get out of it and be on my own... im tired of my parents and because I'm the oldest they both put all their stress on me telling me all their problems and expect me to take care it all... roger is a very close family friend I have been working for him for quite sometime and he is a great christian guy... I want emancipated I'm not at all close with my family

Well then you should consult with a family law attorney or your local social service agency to see if this is possible. In my state a judge makes this ruling in family court, and unless you are able to prove abuse and neglect, you are required to have parental approval for emancipation. You would obviously be able to prove neglect, but I suspect you would have to show that you can provide for yourself sufficiently on your own. Again, you should speak with an attorney to explore this further.
