    Laid Off - Mortgage Lender Will Not Assist
    Me and my ex-fiance broken up in September, he moved out and signed a quit claim deed claim finally in November. During this recession, I've been laid off in Feb, and the mortgage lender claims they can not assist me with a loan modification.

    In the meantime, my ex-fiance is harassing me on getting his name off the loan, not taking into consideration that I am a single parent with no job. I am actively trying to seek employoment in the technology industry to avoid foreclosure of my home and having to move back to NY.

    What rights do I have to secure my home that my ex-fiances threat to take the house from me, since he is working and living in an apartment?

    Why can the mortgage lender reduce my mortgage with my unemployment wages and family financial assistance.

    Considering the volume of homeowners losing their home, I'm trying to save my home with the resources I have yet I'm not getting any assistance. Please advise what steps to take and what rights I have, since I am on the deed, yet we are both on the mortgage.

    First, if the ex was both on the deed and the mortgage, his quit claim deed does not affect the mortgage. In fact it made it worse because any change in ownership can trigger a due on sale clause that is in most morgtages. This clause means that if there is a change in ownership the lender can ask for the balance of the mortgage immediately.

    The lender is also NOT going to take his name off the mortgage. The only way to get his name off is through a refinance.

    Your best bet is to try to find some help refinancing or selling the house. This will be next to impossible until you are re-employed.
