    Off duty store cleark jabs me in back
    I was in a customer service line answered my cell phone and a cashier became available well I did not notice and a off duty store clerk jabed me in my back the survillence video shows him do a undercut upword motion to my back, the insurance rep says the store said the off duty employee tapped your shoulder than after I get the video from the insurance rep it says the gentlemen tapped your back the video again shows his upper cut to my back and his motion was 3 times faster tha anyone else in the video.

    At any rate I had back pain the dr says it was conclusive of a jab or broom stick handle.

    Should I bring a lawsuit on the grocery store ?

    The guy just came up behind you and just punched you for no reason? Holy crap... that dude's got issues.

    It seems he was a disgruntled person impatient but he was a employee of that store and should have known better he was about 55 years old but the video clearly shows it was not a tap should I sue the store you think

    If the guy came up to you and punched you for no reason and everyone is trying to tell you that he only tapped you... then hell yes sue the dude.

    To hawkman: did you or anyone else confront the employee after he touched you? You keep mentioning that the video shows him "making an uppercut motion," but does it clearly show him allegedly punching you? Also, if he hit you with his fist, then the marks wouldn't be consistent with a broomstick.

    At any rate, I don't see the grocery store having an involvement - UNLESS that particular employee had past issues with violence and/or aggression. You can try to sue the individual for any medical bills you may have incurred as a result of his actions - but that doesn't always mean you'll win.
