Arrested twice for same offense once as a juvenile second time as adult
I was arrested for Shoplifting at wal-mart twice once as a juvenile and the second time as an adult so I was wondering if they could get my juvenile record and use anything from it in this charge or if they can arrest me for trespassing since I was banned from wal-mart but it was in two different county one was in Banks County ( juvenile ) and the other was in Hall County ( Adult )

    Hello k:

Yeah, you could be a second shoplifting offender. I wouldn't do it again. If they want you to stay away, I would.

Yes, walmart will have the record in their files and they are not required to "seal" any records. Only your police or court records are sealed as a juv.

If Walmart reported this on a national data base of their own, as to the tresspass and being banned. ** how could they know you were banned if they did not have it on their computers.

It is possible of course your attorney could object to this if it was part of the discovery of evidence you will do to find out what they are using against you.
