    Reversing A Child Custody order
    My child's father (lives in TX) went to court three years ago and got a false child custody and child support order against me to avoid having to pay child support in California. I have been living in California until about 2 months ago, I recently moved to Houston, TX where I found out through the Attorney General (where I went to file child support against him) that my child's father has a child support order against me. I have always had possession of my daughter her entire life and she has never lived with anyone other than me. My child's father is very manipulative and knowingly went to the Attorney General against me as a means of avoiding child support himself. I need the child support for my daughter but now the Attorney General will not represent me because of my child's father's claim. On top of all of this the Attorney General may have me noted as owing back child support for a child that has always been with me! I have school records and other documentation to prove my child has been residing with me. How can ?I reverse his false child support/custody order and make him liable for lying in the court of law? I can not afford a lawyer however he can so please note steps viable to my pursuit.

    It would be helpful to know where you have lived for the last few years, where the father has lived and when the child support order in TX was issued.

    Also, you say there is also a child custody order in TX? When was it issued, and where were you at the time?

    To answer your question, the father and I were never married but we lived together in Texas for two years, until I left him, then my daughter and I moved to California in 2004 when she was three years old. The father has always lived in Texas. I however just recently moved back to Texas about three months ago. I live in Houston, TX and he lives in Killeen, TX. My daughter is now seven years old.

    I forgot to answer the other part of your question. The father went to court and got the custody/child support order in 2006 while I was living in California. I had no knowledge of the order until recently, and he did not know where I and my child were living at the time that he got the custody/child support order in TX, nor did he have possession of my child. I have never sought child support against him until recently so I don't have any child support or custody order in CA or TX. Till this day the father has done nothing to support our child and the Attorney General has me listed as the non-custodial parent and is therefore not allowing me to pursue child support through them.

    Have you seen this court order ? What exactly does it say ?

    You are going to have to file this in the court the original order came from. It would help if you have a lawyer. Look in the phone book for legal aid society if you cannot afford a lawyer. After you get a custody and child support order the Attorney General will help you collect.
