I've been a salaried employee for a company for almost 10 years. We have had a new owner for 4 who has repeatedly tried to run me off. After an accident last week (no injuries) the operator and myself were told not to work until the insurance investigation. At the end of the investigation the owner sent the operator back to work and wrote MY resignation and gave me a contract to sign. The contract says I have 21 days to make up my mind and or obtain legal council. Does he have to pay me during this time?

I don't know what you need to make up your mind about. Every time I've been fired, I wasn't given a choice, and I wasn't given a contract to sign. Please let me know what the contract says, what you are supposed to DO under this contract, and what your employer is supposed to do.

However, in answer to your question, the contract probably has SOME verbiage about WHEN the contract starts. If you're not going to be fired until the contract starts, then you should be paid for the days until it actually happens.

But, all of this is pretty weird, so you'll have to explain some stuff first.

The info was dated for Friday, April 24th giving me 21 days to make up my mind from then. He is offering me 2 months pay in return for not talking to anyone about anything basically and to agree not to do any type of work in their field, take their customers, clients or employees. That in itself is pure lunacy, all I have done for 16 years is traffic signals, and utilities and he knows I can go somewhere else and 85% of the company would follow me including the operator that had the accident.

It sounds like he is offering you 2 month severence pay for you to not take their clients.

If you think you can get another job easily and that your contacts will follw you, then refuse the offer, resign and find another job.
