    Indefinitely, in theory. In practice, until one side runs out of money/willpower to fight.

    Ummmm I'm on my fourth year. And as the previous post states... we are not settled because I have run out of money and have sort of given up... it never really ends, if there are kids involved.

    What state is this in and what do you mean by drag on ?

    Depending on the state so long as there are filings in the case it can go for an indefifinite period. But when you stop filing ( both sides ) then clocks can start ticking and if not settled in a period ( like 5 years some states ) the courts drop the case. What that means is you have to file everything over and also at that point you are married again.

    My divorce took 4 and a half years, settled on joint custody, now we are in our first year back in court after 18 months off.

    Thank you for your answer! It's been over 2 years! My husband makes $150,ooo per year! We have 2 grown children in college... Neither of them live with there father... What I mean by drag on is how many years, months, a lifetime? He told me he would pay 1,000per month for 5 years! That's it... We were high school sweethearts and married for over 21 years...
    He thinks this is a way to pay me back for a drinking problem I had because he failed to keep a steady job! We lost everything! Now we both have spent money on Attorneys! He said he has spent $7,000.000 I have spent 4,000.00! My parents lent us $43,000 for our 1st home which has never been paid back! I can't ask them for anymore. Should I JUST take the $1,000.00 and run..?

    It can take years as noted, and if there are kids you will be back in court every year or two most likely

    With grown children then the only real issue is assets and if your state allows alimony ( aka.. spousal support )
    How settled are you on the assets and debts from the marriage ?
    5 years and $1,000 a month doesn't sound right. Its best to figure what you should get by the state you live in and then develop a plan.

    What state is this in ?

    I live in the state of California! What due you think! I filed for BK over 2 years ago... So there isn't much. He has 3 car payments, lives with his sister pays no rent and like I mention before makes over $150.000 a year and I'm sure he get quartley bonuses...
    He can't get away with this can he?

    Spousal Support or Alimony Lawyers

    Because of the length in time you both were together and depending on your contribution to his status today it is possible to have it ordered for a lifetime. As far as the amount the calculator on the Ca website is down as far as the spousal support is concerned. To really nail it down because some rules seem to vary by county you should talk to a lawyer near you. The local BAR can set you up for a small consultation fee so you can have about an hours time to ask questions and decide how to proceed. The fee is dramatically reduced from the norm.
