I would like to know what is involved in terminating parental rights in FLorida... my ex husband might be going to jail on a 3rd degree felony for organized fraud. He could get anywhere from 5-15 yrs in jail. I have a 15yr old and 9yr old daughter. He is court ordered to pay child support and has not been paying. If he goes to jail I want to get his parental rights terminated. He is not a good influence on my kids and I am afraid he is going to get my 15yr old in a lot of trouble with what he is teaching him. My 9yr old was sexually assaulted while in his care by his girlfriends 17yr old son. I want to be able to do what I want with my kids and not have to get his permission if I want to move out of state or something. If I need someone to help me get his rights terminated by wanting to adopt my children I have someone in my life that wants to do that. He wants to adopt my children and be the kind of father they need in there life.

Of course if he goes to jail for 9 years or more the issue is really mute since he will be in jail and can't see the kids, and can not make or get them into any trouble.

My issue is, if the daughter was assaulted what happened when you got a protective order against them to stop her from going back over there ?

And what happened when you took him back to court for non payment or when you had the Fla child support enforcement go after him before he was arrested.

But after he is sentenced you can file a motion in the court to terminate the rights because of the prison sentence.

I have a restraining order against the kid... but the judge said that her father still had a right to see her. When the restraining order expires in June I will be back in court asking the judge to extend that order.

Child support enforcement has told me that they have sent him notice about non payment... he has not been sent to jail yet on his felony charges. He goes to court this week and if he goes to jail I refuse to take my kids to that place to see him I feel that is no place to take a child.
