Please help.. I run a tractor trailer with a team partner. He recently had his picture taken by a traffic cam. My company gave out my name and address without my written consent and there was no supeena sent as well as no verbal permission given. They just gave out my information to the town of Marshal , Tx and never even did an investigation to see which one of us was driving. Is this legal for them to to this? When they first hired me they told me NONE of my personal information would EVER be given out because of the Privacy Act. Yet they did any way. Can I take legal action and what kind of lawer would I need? Thank you.

Right now there are no laws to protect you against these new traffic cameras. They are even being used in some states to scan thousands of cars for unpaid parking tickets and also being used in court cases. Police cars have them and can automatically scan every vehicle within a certain radius and this info goes into a large database and there are no data integrity laws or privacy acts put in place.
I'm not promoting illegal activity, but you can purchase a type of product on the internet that sprays a gloss on your license plate that is not detectable to the human eye but prevents these cameras from reading your plates.
This is a big issue in the UK right now and quickly spreading to the states.

Yeah it's a huge problem here as well, so much for The US's Constitution... "The right to face your accuser" I was more concerned about my personal information being given out without my permision..

Couple things.. The Privacy Act doesn't protect consumers. It protects COMPANIES. It's kind of like the Patriot Act, in that it's anything but. So, you don't have any legal grounds to go after your company - at least not yet...

When the ticket arrived, the picture WAS in there. Somebody in the department just didn't look. I'd write them a letter telling them that the mistake they made THIS time didn't cost you any money... But, if they do it again, you'll sue them. Send your letter certified, return receipt requested.

Of course, be prepared to be fired, though.
