    Early Probation Termination
    At the beginning of my sentence May 1, 2008 I was placed on 2 yrs probation with the special condition that if I had No Violations within 1 yr. my probation would automatically terminate successful. I have sent a motion to the judge, probation, My PA and the state asking if termination will be granted as of May 1, 2009... What will happen next? Will there be a hearing? Will I still need to report to probation in the month of May if I haven't heard anything from the courts by then? Im assuming as my paper work states, "If No Violations after 1 yr, probation will AUTOMATICALLY TERMINATE SUCCESSFUL. So as of May 1, 2009 I am no longer on probation? :confused: Am I correct? HELP HELP HELP

    PS - Your probably wondering why I haven't asked my PO this info... she's defitnatly not all there, and has got my file mixed up on several occasions... this is why I do not feel comfortable asking her these questions.

    Only your PO knows for sure. I wouldn't take a chance and NOT report, only to be violated.

    You should have filed your motions after May 1, 2009 to be sure. In the meantime definitely report to your PO on the proper reporting days until you have been notified not to report any more as you are off probation. I would ask for the appropriate paperwork stating you are off probation when they tell you your probation has been terminated. Can't be too careful when it comes to your freedom.

    I'd believe it. It's clear as a bell. Automatic means nobody has to DO anything to make it happen. Besides, if THEY don't believe it, you've got a get out of jail free card with your judgment that has the word "automatic" written on it.

    WELL PERSONALLY FOR ALL OF YOU WHO WANT TO KNOW!! I prepared a motion for myself (which you can get offline, search "google" for "motion to terminate probation") and I sent it to probation, the judge, and my defense attorney/public defender, and took a courtesy copy to the court house to file in the court file... which also had a letter attached of everybody who was sent this letter, and this you only do to verify that you did send these letters and to whom you sent them too. That way no way can say they did not receive a copy. I did all this 3 weeks prior to May 1, 2009. I called the court house on April 29th 08 and they said that as of April 31, 09 as it states after 1 yr you've completed everything and paid for everything and you have Successfully completed your probation the judge will sign your motion, or prepare her own (which in my case happened) on the day before you were put on probation and will mail it out the day of your probation which you will receive your letter on the 2-4the day after your probation started stating PROBATION TERMINATED!! CONGRATULATIONS - I HOPE YOU Succeed LIKE I DID... GOOD LUCK! Oh and NO I did NOT have to report to probation!!
