In State of Florida, Can Homeowner association evict homeowner from the property for non paid maintenance without foreclosure process.
First, NO ONE can evict a homeowner. A homeowner owns the property (unlike a renter) and cannot be evicted. Second, the HOA can't foreclose because they don't hold the mortgage. The process of foreclosure is when a lender repossesses a property because of a default on the loan.
The only thing the HOA can do is place a lien on the property for the outstanding dues.
