My son is 16 months old and I was denied child support due to his father being on SSI. I think its not fair and he still can work and make money but he doesn't help support his son in anyway. Even people that are retired and get social security can have child support taken out. My son's father is still making more babies with 5+ kids and more on the way. I am a single mom busting my butt to support my son with help from my parents. I can't terminate his rights because I will lose my medical, also I was told by many people to take him to court. I wasted my time and effort to achieve something like this but to have what felt like a big law book thrown at my face. I was told by my county that I could call the social security office to see if I can get benefits for my son but that was a big fat NO!!

You CAN get social security disability benefits paid to your son if his father is receiving disability benefits. Have you gone to their office with your son's birth certificate and talked with a person there? Don't call them - go in person with your documents. The father may have to fill out paperwork as well, but what does he care it won't come out of his hide in any event and your son would be given the equivalent of "child support" by this dead beat.

And as far as terminating his rights, you can't.

SSI is not considered income for child support purposes because it's a form of welfare. It's a government give away program.

Look into what public entitlements your son may be eligible for.

I have been researching this for so long and he was lazy enough that he didn't qualify for the SSDI. I even talked to a lawyer that said there is nothing I can do even after he dies. And as far as programs for my son I am on WIC and getting foodstamps. The county I live in is very rude and is not helpful whatsoever. Can someone help me I am so frustrated. The courts were going to grant him visitation too until he spoke up and said that we will decide. He has bought my son only 1 thing since he was born and that was a halloween teddy bear for xmas of 2008. Him and his family denied my son until June 2008 when DNA came back positive. My son was born December 2007. He don't call and the last time he seen his son was 1 week before xmas of 2008.

Your story isn't adding up. First you say your ex-partner is on SSI; then you say he didn't qualify for it. If he is receiving SSI of any form, then your child is eligible - AS LONG as he has been proven to be the biological father. You saying he is doesn't mean a hill of beans unless a court-ordered DNA test has been done.

You say you were denied child support; did you actually file a case with the courts? You said you feel like a "big law book was thrown in your face." Did you actually file or do you feel you weren't given enough information?

First of all he was denied ssdi because he didn't work. The court ordered the DNA test and yes I went through the stupid court proceeding to see if I can get child support. You obviously don't know what the heck I have been through.

You're right, I don't because nothing you say makes sense. Maybe if you'd give us clear information, we could know "what the heck you've been through." He can't receive SSI and not receive SSI at the same time.

If he's receiving SSI, then your child qualifies for SSI as well. If he has been denied SSI, then you should be able to collect child support.

Have you applied for AFDF benefits for your son? This is a form of welfare since his father cannot or will not give him any child support. This all will hinge upon just how much you make as well. Also Food Stamps can help put some food on the table but you have to meet their criteria as well.

My legal advice isn't very--and I figure this post will be removed, but I have to say it anyway:

I have no sympathy.

You slept with the guy, you made bad decisions, and you decided to raise your child, KNOWING what a jerk you conceived your child with.

Yeah, it sucks that he's not supporting his child. Ticks me off too.

Ticks me off even MORE, though, that you figure the TAXPAYERS should help support your child through welfare programs--even the welfare programs of the biological father.

Nope--I don't know what you're going through. But you have no idea what any of the rest of us have gone through either.

You've made choices that brought you to this point--now live with your choices and stop p!ssing and moaning because you can't get more money because you weren't thinking ahead when you chose the father of your child.

To be eligible for SSDI a person must have worked a certain number of years and earned a certain amount of money depending on their age. There are a number of years during which time the person has to have earned a certain amount of money and if not they won't get anything. Young people- early twenties - can still get SSDI even though they haven't worked enough to meet the criteria for older persons to qualify.

To get SSI you just have to have an illness that qualifies you and a low enough income.
SSDI is Social Security Disability Insurance - insurance you pay for when you work tthat kicks in when you are disabled totally

Supplemental Security Income (SSI) is a Federal income supplement program funded by general tax revenues (not Social Security taxes):
It is designed to help aged, blind, and disabled people, who have little or no income; and It provides cash to meet basic needs for food, clothing, and shelter.

The woman clearly stated the guy hadn't worked enough to earn SSI.
Her child probably can't get SSI unless her income places them below a percentage of the poverty line- for 2 people its likely super low. For my family of four it would be $800.

Being on SSI means you are virtually destitute and disabled. Taking funds from people in that situation would be creating another problem.

Well the office should have them apply for what they DO qualify for not just turn them away

Usually most welfare offices will submit SSI apps along with AFDC and TANF and FoodStamp applications. Basically she is eligible for some program unless she earns more than a $1800 a month or so, depending on where in the country she lives. All the programs are based on federal poverty income levels and percentages of them. Her child's father is just an ill person who hasn't been able to get along with her. If she is healthy she should be able to earn enough to not worry about his money in his present state. Remember SSI is going to pay that guy less than $9000 a year - that's his TOTAL income and he is disabled. It's a messed up situation.
