    How do you go about giving up rights if you're the father?is it legal?
    My husband is trying to give up a child and the sitiuation is sticky what are the procedures and is it legal / how long does it take and does have to know anything to be prepared?

    It is almost impossible unless someone is available and willing to adopt the child. Even if he is able to surrender the child he still will be responsible to pay support.

    What are the circumstances?

    This question has been asked an answered hundreds of times in this forum. In fact, there is a sticky note at the top of the forum that deals with the issue.

    Getting a Termination of Parental Rights (TPR) is very difficult. A parent does not just "give up a child". The courts will not allow that. And they definitely will not allow a parent to relinquish rights just to get out of paying support.

    Your husband cannot be forced to be a father to the child, to spend time with the child, etc. But he can and will be forced to support that child.

    So he (and you) needs to be realistic and start dealing with this situation responsibly.
