Ok so I have this roommate my husband and I were helping out she is always late with rent does drugs and drinks all the time. She is putting so much stress on my husband and I it seems like we are always fighting. I want her out as soon as possible how early can I have her out with out getting introuble by the law?

You have to give her a written notice that her tenancy is terminated and she must move out within 30 days. (The time could be less depending on your location.) If she doesn't move out at the end of the notice period then you have to file a lawsuit to have her evicted.

You could try a pay or quit notice. This gives her a shorter amount of time (3-10) days to pay her rent in full or vacate. The drawback here is if she does pay, you have to start the process over again.
