Yesterday afternoon on my way out of school I came to a stoplight and stopped. The car behind me obviously didn't see the stoplight and kept driving and ran right into the back of my car. My daughter was in the backseat. Fortunately, she was not injured and I wasn't either. I don't have a driver's license, but I do have insurance. The insurance only covers my mom if she is driving the vehicle though. The guy that I got in a carwreck does have a driver's license AND insurance that has liability. My car got totaled, it wasn't drivable at all. My gas tank and muffler fell out. I was given a ticket for driving without a license. Now, I am wondering what I must do. I woke up this morning and my neck hurts really bad, I can barely turn my head. I was told that when I go to the hospital to call his insurance company and let them know what happened. Is there any way that I will get money for my car or for the damage? I also was told that his insurance company will give me a settlement for the injury and put a quote on my car for the damage. Im not sure what's going to happen next. If anyone can help me by answering any of my questions I would greatly appreciate it.

You may or may not have to sue the other driver and their insurance company.

You not having a drivers license or insurance has nothing to do with the claim against them, it only means you will be given a ticket for that.

If the car was only insured with the mom driving, then if you were driving the car was also uninsured. You may still be ticketed for that if the police figure that out.

But beyond that the wreck was the other persons fault and they would have gotten a ticket for that. They or their insurace is to pay for all of your damages, medical and cost to pay the value of your car.

*** or your moms car , who owns it? The owner of that car needs to figure out who much it is worth so they can ask for that much to settle.

next get your story down better, you said you and your daughter was not injured, then you say you were hurt the next day.

So you were injured, if you say you were not injured, then one story is wrong

You might want to get an attorney. The other driver's insurance will pay, at least up to the limits of the policy. But to make sure your rights are protected you should have an attorney.

Yes if there is any issue at all of them writing you a full check, get an attorney

OK. And about my injury. I'm feeling a lot of pain in my neck and lower back. I don't know if I should go to the ER to have it checked out or wait until Monday to go to a chiropractor. I heard that in order to get a settlement for the injury I have to be seen within 48 hours after the accident. What do you recommend?

The "48 hours" is not true in any State, to my knowledge. All delayed treatment does is open your claim to suspicion.

Are you asking about payment of your medical bills or settlement for the injury - these are different things.
