Summary offense plea entered (not guilty)
My fiancée is facing a potentailly hazardous time in ALberta as his ex put false charges for assault on him in 2004\2005... He attended each court hearing(8 times) and she was never present nor had any laegal representation. He entered his plea of NOT GUILTY. SInce then she left the province (moved to BC) and he followed so he could maintain contact with his son. We have a terrific opportunity to return to Alberta for excellent jobs, but he is concerned about the charges. Is there a statute of limitations that applies here? Have the charges fallen off the books now because she has never pursued them? Please offer whatever advice you can, we have a wonderful family together tat would benefit greatly by this opportunity.
    Thanks everso much, God Bless

    Hello hap:

Once charges are filed, it's not HER that is pursing them, it's the Crown. Nope, the charges haven't fallen off the books. Plus, I'll bet a warrant was issued, and it's good in BC too.

I'd hire a lawyer in Alberta as soon as you can.
