    Hello,

    I am a resident alien working in the USA under H1B visa. I am paying the tuition fee expenses for my brother who is a F1 visa student. My brother does not earn anything (no scholarships/grants from school or other sources), and all his tuition and academic expenses are being covered by me (financially).

    Is there any way, I can claim him as a dependent on my tax return?

    I understand that the dependent needs to qualify as a resident or US citizen, in which case this can be a problem.

    Is there any other alternative, or is there (currently) simply no way to include a nonresident alien on my tax return. Please bear in mind that I am a resident alien and I am paying taxes as a US resident (I am filing form 1040 US) for my tax return.

    Any suggestions in this matter, would be very, very helpful.

    Your brother is not U.S. resident for 5-years on F1, so you can not claim him.
