    Hello,
    I am on H1 for 2008 and my wife is on h4 with no SSN. Do I need apply for her ITIN using w-7 with my federal return filing with married and filing jointly? Or do I need to file for extension and apply for ITIN and then file foe fed return?

    Submit the Form W-7 WITH the tax return. If you submit the Form W-7 by itself, it will be rejected.
