    I need some help/guidance. I am involved with a wonderful woman in California who has a 2 1/2 tear old. The problem is that I have a felony on my record for non-violent crime (arson with intent to defraud insurance in Indiana) She is just worried that her ex will find out about my record & use it against her to get full custody. Can they do that? It is the only thing on my record, and I have long, stable work history & retired from the military too

    I frankly wouldn't worry about it too much. Of course, the ex could conceivably raise this as an issue, no one can guarantee he won't, but I very much doubt he's going to get very far with it if he does.

    We have a specific statutory reference to persons convicted of sex offenses involving minors (Family Code Section 3030) or residing in a household with such a person that has a direct bearing on custody rights to children, but that does not appear to apply in your case.
