    Spouse died and I need to file bankruptcy.
    My spouse signed the loan papers for our mortgage in 2003. I did not sign it. When we received the deed from the county court it had both our names on it.

    My spouse passed away 2007. I am having to file bankruptcy because we exhausted our savings and took a second loan on the house because of medical bills and caregivers.

    When I file for bankruptcy will I be allowed to keep the home. I have been making the payments since 2007. We have a 17 year old daughter. What will happen also about the second loan?

    If you are current with the mortages, and you can keep paying the mortages you can keep the house,

    Also it will depend on how much equity you have.

    But if you can not keep the mortages up, then no you can not keep it.
