We looked at a pickup truck over two weeks ago. We gave a deposit and requested that the seller provide safety certificate, emission test and purchased the buyer package. I never heard from him again until I called a week later and he told me when he purchased the sellers package that he found out there was a lien against the vehicle. Can we legally request our refund back, we only made a verbal agreement. The sellers package also indicated that there was some type of insurance claim against the vehicle as well. We are now a little leary about the purchase, but don't want to lose our $ 500.00 deposit which we made by cheque ( which has been cashed ). Can he legally refuse our deposit being refunded.

As you cannot purchase the vehicle until he pays whatever lein(s) may be on the title, ask him to return the deposit. If he refuses to do so, sue him in small claims court.
