    FICA refund process time
    Hello my status is an F1 and I'm on my OPT, where I work they mistakely withhold my money on social security and medicare, so my company said they going to reimbursed that for me. My question is :
    1.how long the process of the refund?
    2. Does the refund have to be filed during tax refund month (jan-april15?) or can be any time?

    My wife also has a similar situation. She came to the US in August 2004, was in F1 status till September 2008 and got OPT starting October 2008. The university (where she works) started charging Social Security and Medicare taxes right away starting from October 2008.
    I have the following question and it would be great if someone could clarify.

    (I) Does the OPT status automatically makes an individual (well within the first 5 years of F1) subject to Social Security and Medicare taxes?

    (ii) Are F1 individual with OPT exempt from the substantial presence test? I know that the answer is YES if it is F1 without OPT within the first 5 years. If the answer is yes, I was also hoping someone could provide reference in IRS website so that we can point it out to the university tax department.

    If your company is going to reimburse you the SS tax and Medicare tax, then contact them.
    If they can not reimburse you then file Form 843 with IRS. : Your U.S. Tax Return: Social Security and Medicare (FICA) Taxes for Non-resident Exempt Individual

    My company will reimbursed it for me the thing is... they said the process will take 3-9 months to get the money back... is that true?

    I don't know how long it will take for the company but in case you or someone else will have to do it with the IRS: I did that last year and it took four months to get the refund from the IRS. So it took a while but I didn't have any problems getting it back.
