Resident Alien Filing for w-7 form
    Hello,

Iam currently holding a h1-b visa and my wife is on OPT after completing her MBA. She doesn't have an SSN as she was not allowed to work during her course. Now Iam filing for my taxes jointly and since she doesn't have an SSN I have to get an ITIN number for her.

My question is when I file for the ITIN with the w-7 form and check for option (e) , should I send all my tax documents i.e federal( 1040 A )and state tax ( Form 760 ) forms to the address noted in the w7 form along with the notarized copies of my wife's passport ?

OR should I just send the Federal tax form ( 1040 A ) along with the w-7 form and the notorized copies of my wife's passport.

The address noted on the w-7 form is the following.

    Internal Revenue Service
    ITIN Operation
    P.O Box 149342
    Austin, TX 78714

Also, should I be mailing the marriage certificate as well ?

    Hoping for some help.

    Thanks
    Ashwin

You need to send only the Federal. For your state tax, apply for an extension and then file it once you get your wife's ITIN
