    Do I need to file my state taxes before filing bankruptcy?
    My husband and I filed our federal taxes for the past two years but not our state. We are in the process of filing chapter 13 bankruptcy. Do we have to file both years prior to filing the chapter 13? My wages are being garnished now and we can't make rent each month with the garnishment in place so filing asap is quite urgent. I can not find my 2007 taxes and had to request them from the IRS prior to filing my state taxes. Thank you

    First no you don't have to file your taxes, but you can't include them in the bankruptcy, taxes are excluded from bankruptcy.

    But you can file your state taxes, even if you owe money, then you work out the payment with them, the longer you wait, the more penalty there can be
