    First year of H1-B tax status
    Hi All,

    I came to US on H1-B in October 2008. I came on J1 visa in 2006 for 80 days. What is my status for filing taxes Non resident alien or resident alien?

    If you are single, you will file nonresident tax return.

    Hi,
    Thanks a lot for your response!
    I have another query, can I then claim back social security and medicare taxes?

    Also I read I can file as resident alien if I take extension, then my worldwide income is taxable.

    You will not get the FICA taxes back.
    You can not file as resident alien for 2008.

    Thanks a lot Mukat. That's a great help. Actually I called IRS and they told me according publication 519 I can file as resident alien if I take extension so I be a resident alien in 2009 but then for 2008 I have to take care of my worldwide income.

    I am not sure what all forms I would need to fill and supporting documents and how complicated it will be

    If I file as NR then in itemized deduction can I put moving expenses. How to maximize my returns?

    The extension propcess of which you speak applies ONLY IF you are married.

    If you are single, then follow Mukata's advice and file as a non-resident alien. You can file Form 1040NR and submit Form 3903 for the moving expenses.
