    Hello all ,from New Jersey 3 weeks ago my wife left with our 3 yr old daughter,they went to a woman's shelter. This is the second time in the past months that she has done this. In the interim I called legal services and went to court and filed for custody of my daughter.
    When I filed for custody, their was no complaint against me nor a tro.I know she went to a
    Woman's shelter cause we have no family or close friends. I miss my little girl and I don't
    Think it right to keep a child away from either parent, I have not seen her in 3 weeks.
    Their has never been charges of domestic violence. However, she did call the police a couple times on my 2 sons (from a previous marriage) while I was at work. The reason
    She called the police was because my son would not let her on the computer, the second time she was verbally abusing my 2 sons by bad mouthing their mom and older son gave
    Her some lip. I am in the middle of this fiasco and I don't want my child living in a shelter.
    My wife is a immigrant from russia and I got her her green card about 3 yrs ago.
    She does not drive , or have a job she stayed home and took care of the baby. I do love
    Her and always tried to encourage her ,help her and guide her so we could try to have a
    Stable house. In any case there are no complaints or charges against me. What else can I
    Do while I am waiting to go to court. It very hard trying to get answers and having the
    Door slamend in your face.the anxiety and depression is like a bad boardwalk roller coaster ride.any advice would be helpful . Thank you

    This is all you can do, you can of course not force her to live with you, and you may or may not get custody, you may get joint custody, or just get visitiation of the child,

    It is possible you will have to pay her support, and if she gets custody, also pay child support.

    Merely living in a shelter does not mean she may not get custody, many even have legal support though legal aids to help them with the fight for custody.

    Thank you for the quick response. But isn't this child abduction? Also I know my daughter is crying to see me , isn't this a for of mental cruelity towards the child. :confused:
