Backstory:
I am a mother sharing joint custody with my ex husband. He sees our 8 year old daughter every other weekend. I may want to move after I finish my BA (1-1.5 years from now) in order to enter a proper MA program. The program I am looking at is in another state... just 15 minutes or so over the line. This would put a driving distance of only 3 hours between myself and my ex. I am certainly willing to meet half way or even drive my daughter to him for visitation.

Question/Concern:
Do I have to notify the court in order to move across state lines with my child? I am certainly willing to notify my ex before moving... but, I have a feeling he would do anything he could to make things more difficult for me despite the fact his visitation would not be affected. I would certainly obtain an attorney if I had to... I am hoping you lovely people can point me to a resource that can give me more information on this topic.

You do. You have to notify the court if your move is going to change visitation at all.

However, if he agrees to your concessions, its essentially a rubber stamp.

Thank you so much for the answer... My moving would change visitation. Do I still need to notify the court? If so, where can I find out how to do that? Is an attorney always required to do that sort of notification?

Not necessarily, but certainly helpful. You do need to notify the court. Call the local family court and ask them about how you go about moving. They are used to dealing with non-lawyer types so should be able to guide you.

Part of the issue is that if you are going to change the terms of the visitation agreement, and to be honest if your ex does not agree, the court may not allow you to move.


Three hours, effect the every other weekend a lot, on Friday, instead of him getting the child at 5:30 or 6, when he gets off work, can you get the child to his location at the regular pick up time on his weekends,

At a min you would be expected to provide for transportation since it is not him that is moving.

This is one of the issues, you can not move and effect his visits ( if he is using them) without getting the court to OK it, and the court will not limit his rights and visits without his permmision normally

If your going to school and holding down a job how are you going to find all the time to drive back and forth so much ? A 12hr drive every other weekend is a lot of driving to be doing as a student. Are you prepared to answer the courts as to how your going to do this ?
