    Unmarried Florida father's visitation rights


    I'd like to know what kind of visitation rights an unmarried father has to his baby. She is now 7 months old. How much visitation could be expected to be awarded? And if visitation is awarded, if the father has to go out of town to work for several months at a time, can he choose who gets to see the baby on his visitation schedule, for example, myself, as the grandmother, who has established an ongoing, healthy relationship with the child. The baby's mother and her mother are now trying to not let me see the child as I was. I feel there will be no chance of my son seeing her if he does not do something to legally commit to visitation.

    You might have a case by going to court and fully explaining the situation. Florida does recognize Grandparents rights. Your son would also have to appear and it may be possible that your allowed to substitute on those grounds.

    Its hard to say but it might be worth looking into so long as your son isn't derelict in his duties as a father and visitation is concerned.

    First if you were not out of town, you may even get joint custody, being or not being married has nothing to do with it, The ability to care for the child does.

    You could get at least every other weekend.

    The father has the same rights as ANY legal parent. But he has to go to court to exercise those rights. If he does get visitation, you can't take his turn for him. But he can share his time with you, but all three of you spend the time together.
