    Doing 2008 taxes, and ask for refund of 2006
    Hello all,

    I was in US in 2006 as student (visa J1) during 3 months with an american fellowship and I had a withhold of Fed Tax. I did not my taxes for this year.
    In 2008, I came back again to US with visa J1, and I'm doing my taxes.
    In both cases I do not apply as taxable resident.

    The question is:
    Can I ask to IRS for a refund of 2006?
    If yes, can I use the same forms 1040NR for 2008 year? Any clue?

    For 2006, you must file you tax return for 2006 to get back the federal tax withheld. You must file non-resident tax return Form 1040NR or 1040NR-EZ and Form 8843. Read: Your U.S. Tax Return: U.S. Tax Filing Requirements for Non-Residents

    For 2008, were you present in the U.S. in 2007 on J1?

    In 2007 I was in my country continuing my studies. Where do I get a copy of 1040NR of 2007 form? Internal Revenue Service are only posted 2008.
