    Voluntary Vehicle Repossession
    We live in Texas and my son has a car that he cannot make the payments on. He is unemployed and cannot find a job. He owes a lot more on the car than it's worth. He asked the bank to come and pick up the vehicle as a voluntary repossession. He told them that the car will not crank, probably because of a dead battery. The bank said that they will not come and get the car because it is inoperable. What should he do? He just wants to turn the car back into the bank and have them come and pick it up!

    They don't have to just "come and get it" they can attempt to make him pay, they can allow late charges, and interest continue so he will owe more and more.

    Also even after they take it, he will still owe them the difference and believe me they will sell it for 1000's less than even its current value, when they sell it at auction normally.

    So lets say he owes 10,000 on it, and they repo it, first they add on a repo fee, then they add on legal fees, and interest, and attorney fees, so that 10,000 goes to about 14,000 or more. The car may sell for lets say 5,000, so after the car sells, he will still owe 9000 which they sue for a judgement on.

    he is much better getting it running, and trying to sell it for what he can, and pay the bank the differnece.
