    Child Support and Lien on a house
    My wife's ex husband routinely does not pay child support. This is in the state of NH, he is currently several thousand behind, claiming he is out of work but is in fact getting paid under the table. He routinely will miss 4 or 5 weeks, then suddenly pay for 2 weeks in an effort to circumvent the system. He just purchased a new truck estimated kelly blue book at 15,000.00 dollars. Can we put a lien on his house on his back child support that he currently owns?

    You cannot do it directly, but I believe that Child Support Enforcement can.

    Have you spoken to them?

    Your wife needs to go back to court and file for contempt. They'll schedule a hearing and her ex will have to show up and give a pretty good excuse as to why he hasn't been paying.

    Also, she should call Child Support and ask them why they haven't intercepted her ex-husband's tax refund.

    Thank you for the advice, are you aware if there is a monetary amount that he has to be behind on in payments before a lien can be placed on his property?

    In my state, they'll file for interception of tax refunds if you're more than $100 behind. Although my friend's ex-husband's returned was flagged for interception - the Feds mailed it to him anyway.

    If he's making payments, they probably won't file a lien. Granted, he's not making them on time but he is making them.
