    1040 NR or 1040 NR EZ, if I have donations to charities made?
    Hi:

    I am on F1 visa starting from 2004 August till today. I have read in the articles that I am a non-resident for tax purpose. I have the following questions I am not able to figure out.

    1) Should I file 1040 NR EZ or 1040 NR?

    2) I have made some donations of more than $700 in 2008 and have all the receipts. These are Indian non-profitable organizations. How can I use the donation amount in 1040 form? Can I use the donation deduction only on US charities? Should I have to use 1040 NR because I have to claim charity deductions? Can't I claim these on 1040 NR EZ? As I am an Indian citizen, I can use the US-India tax treaty ($5450). Is it OK if I use the donation amount too along with the US-India treaty deductions?

    If anyone has any clue on this, please let me know.

    1. If Form 1040NR-EZ meets your requirements file this.
    2. When you are using treaty based deduction of standard deduction instead of itemized deductions, then you can not take itemized deductions.
