    Is this roommate on the lease? What state?

    If you are the only one listed on the lease and you took in a roommate then you have the right to evict. But if both of you are on the lease then only your landlord can evict.

    If you're going to evict your roommate then the first thing you do is give them a written notice. If you're evicting for non-payment of rent then you give them a 3-10 day written notice to pay in full or vacate. (The time depends on your specific state law.) If they don't pay in full by the end of the notice period then you file a lawsuit for eviction. If they pay in full at any time up to the court date then the whole procedure gets canceled.

    If you just want to end their tenancy then you have to give them a 30 day written notice that their tenancy is terminated and they must vacate. If they haven't vacated by the end of the notice period then you file a lawsuit for eviction.
