    Standard Deduction for L1-B ?
    Hi,

    I went to US between jan 19th 2008 and may 17th 2008 - four months. My first visit to US.
    Visa - L1-B
    Went to work at client location for indian company.
    Got my W2.

    Now decided to file 1040NR-EZ and filled it.

    Right now, in Itemized deductions is filled in only my State tax... which is coming to about $600...

    But can I use any treaty benefits to make it a standard deduction?

    Can I use the below?

    "Tax exemption based on tax treaty on wages
    article 21(2) of india us tax treaty $5450"


    I understand that I am not a student or business apprentice, but I am not able to find the 2008 version of Pub 519. Has anything changed from the 2007 version?

    Please let me know asap.

    You are NOT entitled to the standard deduction. However, you ARE entitled to claim your daily living expenses using Forms 2106 and 1040NR.

    The 2007 version of IRS Pub 519 is the latest version available.

    You cannot claim the standard deduction under the treaty because you are not a student or business apprentice.
