    Debt collector called 7/8 years old credit card bill!
    Hi, I got a call from a debt collector for a old credit card bill (7/8 years). They are trying to collect the money with interested up to now. What should I do? I live in Kansas. Kansas Statutes of Limitations are: 1) Written agreement, contract or promise: 5 years.
    2) Expressed or implied but not written contracts, obligations or liabilities: 3 years.
    3) Relief on the grounds of fraud: 2 years. All these time I was thinking its gone from my credit report since its over 7 years and I am free from the liability. Can you guys please advise what should I do or need to be done. Thanks for your advise in advance.

    Is the debt legitimate? Then you *should* pay it. But seeing as it is out of the SOL, there isn't much they can do but annoy you until time ends. Whatever you do, do not pay them anything or confirm that the debt is yours or even exists. That resets the SOL.

    Tell them to put it in writing and mail it to you and not to call you any more on this matter. Once you see it in writing you can take further steps. Until then, do not send them a dime or acknowledge the debt.

    I don't know where you got that idea. You are NEVER free from a debt liability until its paid. The owner of that debt has a right to try and get you to pay it. However, once the SOL has past, they are severely limited in what methods they can use to collect on the debt. They will no longer be able to use the court system.
