Hello

I am pratik from India entered and working in US from Oct '07 through H1B visa. My spouse(not working) & one kid(3 years) joined me in Dec '07 through H4 visa still both in US with me. I have a SSN but my spouse and Kid do not have SSN. I need to file my returns for 2008 jointly and please assist me in doing this.
I am filing their 1040 with attached W-7s to get them ITIN numbers

In this form I have a question,

1.) Should I apply as a non-resident alien or resident alien ?
2.) I am eligible for child tax cradit or not.

You are a resident alien and you may claim the child tax credit after your wife and child get an ITIN.
