    Applying ITIN
    Hi

    I was in US last year for more than 183 days( resident alien) .I returned back to India later in 2008 and got married .
    I am currently in India and is in process for filing my US taxes .My queries are :
    1.) Can I file tax for year 2008 as Married (wife never travelled to US) ?
    2.)If Yes and if I need to apply ITIN for her , what all supporting documents I have to provide ? Does Notarized copy of her passort (only photo page) would do good or Do I need to furnish more documents (like marriage certificate etc) ?

    1) No, you cannot, because, even though you met the Substnatial Presence Test, you were NOT in the U.S. for every day since 1 January 2008, and you are NOT currently in the U.S. to file jointly with your wife.
