I have let a friend watch my home I purchased in Knoxville, TN while I moved my family out to California. In the meantime, he found love, asked a women and her six dependents to move into the home. He originally told me he would send 2400 for first and last months rent to start a rental agreement. I drew one up (I found it online) and sent it to him. He has never paid me, or if he has its been extremely late and with a ton of hassel. He has never sent me the rental agreement and now I would like to go back to my original intent which was to sell the home. What constitutes a rental agreement, what are his rights, what does it take to get him out, PLEASE someone help me.

File in smalls claims court for eviction and whatever rent has not been paid to you. You don't need a written rental agreement in order to have a tenant.
