    Custodial Parents changing school
    I am the custodial parent of my son. When my ex and I got divorced I was living in the same county as him. However, last August I moved to another county. I sent a letter to the court and my ex granting permission for me to move as required in Indiana. It was not disputed and we did make our move. However, I kept my son in the same school district as we were living in before because I didn't want to throw too many changes on him at once. I also got remarried in August. My son has adjusted very well to the move and to my new husband. My son says he loves living where we live (he is 5). My husband and I now feel his is ready to attend school in our county. Do I have to any a court order to do this or can I just tell my ex that I am enrolling him in our school district? We only live about 35 minutes away from him... but he likes to stir things up so that's why I am worried about even bringing it up to him.

    This is a legal question and has been moved. Please take care in choosing the appropriate forum to post in.

    If there is joint LEGAL custody, then both parents usually have a say in where the child goes to school. However, since your move wasn't contested, I would not think you need to go to court over this. I would simply send a letter to the ex stating that when your son starts a new school year you will be putting him in a school closer to your residence.

    If he objects then you may need to go to court.
