Someone used me for green card (I think)
Hello well my question is.. almost 5 years ago I married one of my good friends who is from Asia.. well it didn't last long because I was too young and I felt he pressured me into it to get his green card.. I wasn't ready yet it all happened so fast... well my stupidity but I didn't get it annulled now it's 5 years later (almost) I have a child with someone else.. I still have his last name.. I reported him to INS YEAAARS ago because I couldn't find him and they have done nothing. Well I recently caught up with him and we did taxes together this year (I didn't work this year but he didn't claim my son) so I think I royally screwed myself by doing that. My old last name is on my son's birth certificate because city hall said if I haven't lived with him for more than 2 years then I could use my old last name and he wouldn't have to sign any papers to give up the rights to my son. He also has a baby on the way and well I still have his freakin last name. We are getting a divorce before I graduate.. I'm wondering when we go to court will I get in trouble? Or even get locked up?:(

I doubt you will face any troubles because this is a matter for immigration authorities and not a civil (or family) court to look into.

However why did you not get a divorce? If things were going badly you could have ended it and he could have tried to re-apply to keep his green card by another method.

You can't proved "being used for immigration purpose" so just let it go. File a divorce first.. don't worry. No lock-up, etc. but you need to do it asap.
