    Changing minor child's lastname
    Okay, Im new here and need some help!
    I have a 3 year old child who's father hasn't been in his life since he was 4months old and I gave him his last name BUT HES NOT ON THE BIRTH CERTIFICATE. I am getting married next year to the man that he calls "daddy". My fiancé has been there since my son was about 6 months old. What do I have to do to get his name changed once we get married? I want him to have our married name!
    Hope someone can help!!

    You will need to go to court and have paternity established. At that point the birth father can allow or refuse the name change. It takes both parents consent to change a child's name.

    Its possible to try to have the name forced, but paternity will still need to be established (or a good faith attempt)

    I would find a family law lawyer...

    The other consideration... if your future husband is planning on adopting, the name change can be done as part of that.
