Yesterday, I was completely stopped in a parkade behind a woman. She was in the middle of the lane way and I wasn't sure what she was doing. All of a sudden, I saw her reverse lights and I honked, but it was too late, she'd already backed up into me. She took full responsibility and asked not to have to go through insurance. Now that's she's found out about the cost of fixing her vehicle (2500.00) she wants to go through insurance. I do not have collision on my vehicle (2002 mini van) so the insurance company will not do anything for me. I need to contact her insurance company directly and let them know what has happened.

Someone told me that in parking lots issues, they will sometimes have no fault and I could be responsible for fixing my own vehicle which I do not want to do nor can really afford to?

She's now saying that how can I prove I didn't run into her. There were no witnesses.

Anyone have any advice? Thanks.

I gather you didn't call the police and get a police report.

The only thing you can do is file a claim against her insurer. If she argues that you were not stopped, it could be determined that there is 50-50 liability here. My daughter was involved in a similar incident about a year ago. She claims she was stopped waiting for a parking lot driveway to clear when a car came around her left and turned right clipping her. The other driver claimed she started moving after he made the turn. The insurers chose to make it 50-50 liability so each paid half the other's deductible.

Without collision you may be on the hook if you can't prove it was her fault.

She will need to file a police report to have her vehicle fixed, because by law, an autobody shop will not touch the vehicle without a report.

Huh? What state do you live in? I've had my cars repaired after accidents (too many times, I'm afraid) without a police report.

I was going to give this a negative comment, but on the off chance some state might have some weird laws, I'll just ask for some proof of this. Like the law that says this.

I really can't believe that a police report would be required to repeiar a vehicle. I KNOW that's not the case in NYS.

NOw I'm even more confused. I just realized that Meeg1971 is the OP here. So it appears like she's answering her own question.

I don't know where you live or where this is the Law but this is NOT the case in NY where I live and investigate accidents.

To all, I live in Alberta, Canada and it is the law here, let me assure you.

A parkade is a parking garage - an underground parking lot.

All is well in my situation - the woman's insurance company is paying for my vehicle. It turns out she lied on her police report and said that I hit her, but the damage to our vehicles does not support her version of the story. My van was hit on the front drivers corner and her vehicle was hit on the side as well. Her own insurance company doesn't even believe her.

That was not my question. My question was how do I handle to situation not how can she get her vehicle fixed.

I think I answered your question initially. You report it to your insurer and let them handle it.
