Can I prevent her from taking my son?
My ex wants to move 200 miles away and wants to take my son. I'm totally against it. Can I do something legally that can prevent her from moving completely? I live in Missouri. I have him at least 50% of the time. He is only 8 so by law he can't make a decision where he wants to live until he's 12. Does anyone have any idea or have personally lived through this that can tell me how this will all unfold if I take her to court?

If it interferes with your court ordered visitation, her move will be blocked by the court unless the two of you can reach some sort of mediation.

And no, he cannot decide for himself where he wants to live when he turns 12. He can decide when he is 18. A court may be required to hear his wishes when he is 12, but ultimately it is up to the court.

I have a court order that I have my son on all my non-work days. Everyday I don't have to work he is with me. I'm going to have to file for a motion to prevent relocation. Have you had any similar problems?
