1st offense, 6 felonies in Virginia, punishment?
My question is in regards to my ex-husband. He goes to court on Friday for a Grand Larceny charge. This is his first offense, he has been caught stealing before but they dropped the charges when he returned the merchandise. He also has 5 other non-violent felonies that he is facing in the same county in April. What could he be facing? He actually told me he is going for a plea agreement, that if he goes into the National Guard for 2 years he will not go to jail. However, the prosecuting attorney said she has not agreed to anything yet, she acted like she hadn't heard that, so I think he may be bluffing. Is it possible that he could get probation? The other felonies are 2 uttering charges, one forgery, larceny in third degree, and false pretenses.

    Hello h:

There's no way to tell. There's LOTS of factors that go into it, and we know NONE of them.

As you may have already determined, the outcome is NOT written in stone. LOTS of outcomes are possible depending on how the participants act NOW.

The better your ex's lawyer, the better the outcome.

He will def. get prison and/or jail time... those are serious charges and since he is facing more then one charge it looks worse... so be prepared for the worst and hope for the best... he might get lucky and only get a short term locked up.

5 felonies and no jail? Not very likely.
