    Opt to h1b in 2008.
    Hi, I held opt status from 0101/08 to 09/30/08. h1b from 10/01/08 - 12/31/08.

I hold a passport issued from taiwan. I worked full time in the entire year of 2008 and salary was about 72K.

I have been a student in the US since 2001 for bachelor to master's degree. My employer who I work full time for withheld my SS and Medicare TAX for the entire year of 2008.

I went to a new accoutant and he had told me that because of the wage that I was receiving, I was not able to claim much tax refund. Max up to $1300.

    Is this correct?

    Thank you for your help!!

You will file resident tax return. Complete your tax return and figure out your refund.

Thank you, so I will have to file as a resident alien, in that case I won't be able to claim refund for SS and Medicare tax? Thank you again.

Yes, in 2008 you must pay FICA taxes.
